Rules and regulations for ticket sales
REGULATIONS FOR ONLINE SALE OF TICKETS AND PASSES WITHIN THE FRAMEWORK OF THE OCTOPUS FILM FESTIVAL 2022
§ 1
Definitions
The terms used in the Regulations shall mean:
- Regulations – Regulations for online sales of Octopus Film Festival 2022 tickets and passes specifying terms and conditions for online sales of passes and tickets for Events.
- Organizer – Velvet Spoon Association with headquarters at Obrońców Wybrzeża 4B/7, 80-398 Gdańsk, NIP: 5842773886.
- GoOut – a company of GoOut Sp. z o.o., a ticket and pass sales operator.
- Festival – Octopus Film Festival 2021, organized by the Organizer.
- Participant/Purchaser – an individual who, on the basis of a ticket or pass purchased, acquires the opportunity to participate in the Festival Events.
- Events – film screenings held as part of the Festival.
- Ticket – a ticket for a single Event, purchased online, delivered to the Participant electronically in the form of a PDF file, having a unique verification code; also referred to as an “electronic ticket”.
- Pass – a ticket entitling the holder to participate in selected Events of the Festival, according to the terms and conditions specified in the Regulations.
- Entrance ticket – a ticket entitling the pass holder to participate in a specific Event. The opportunity to download free passes is available only to Participants who have purchased a pass.
- Online sales – sales of passes and tickets for Festival Events made through the Organizer’s website www.octopusfilmfestival.com, the website www.goout.net or through the Goout app.
§ 2
General provisions
- The Regulations set out the rules for the purchase and operation of tickets and passes at the Festival.
- Online ticket sales on behalf of the Organizer are conducted by GoOut Sp. z o.o.
- The prices listed next to each ticket and pass are expressed in Polish zlotys (PLN) and are gross prices including applicable taxes (including VAT) and are binding at the time of placing an order by the Buyer.
- When purchasing a ticket or pass, the participant is required to read and accept the terms and conditions of these Regulations.
§ 3
Rules for purchasing tickets
- The number of tickets for an Event is limited and their sale continues until the pool is exhausted.
- Ticket prices for Events vary. Detailed information on ticket prices for individual Events is available on the Festival website under the “Tickets” tab.
- Tickets can only be purchased online through the Organizer’s website www.octopusfilmfestival.com or through the GoOut website and app.
- The buyer, upon confirmation of acceptance of payment, receives an attachment with an e-ticket and an individual code to the e-mail address provided by the buyer. The code is generated electronically and made available only to the Buyer.
§ 4
Ticket rules
- The ticket entitles the Participant to participate in the selected Event.
- At the time of entry to the Event, the participant is required to present a ticket in electronic form or in the form of a printout, legible enough to read the code with a ticket scanner.
§ 5
Rules for purchasing passes
- The number of passes is limited and their sale continues until the pool is exhausted.
- Passes can only be purchased online through the Organizer’s website www.octopusfilmfestival.com or through the GoOut website and app.
- The buyer, after confirmation of acceptance of payment, receives an attachment with an electronic ticket (proof of purchase of a pass) and an individual code to the e-mail address provided by the buyer. The code is generated electronically and made available only to the Buyer.
§ 6
Rules of operation of the pass
- The pass is named. Only one person can use one pass.
- Pass holders exchange the proof of purchase of the pass (either electronically or as a printout, legible enough to read the code with a ticket scanner) for a wristband. In addition, pass holders will receive a festival bag with original artwork. Passes can be exchanged for wristbands only in person at the place specified by the Organizer (Info Point, Elektryków Street) from the first day of the Festival during the Info Point’s operating hours.
- The pass entitles the Participant to download Entrance Passes for selected Events (all screenings within the Festival except special screenings and the Hidden Screening).
- At the time of entry to the Event, the Participant is required to present the wristband and the Entrance Pass in electronic form or in the form of a printout, legible enough to read the code with a ticket scanner.
- The opportunity to download Entries ends at. 4 p.m. the day before the start of the Event. After this hour, the entire pool of free seats goes on sale as single tickets.
- The pass entitles the Participant to participate in selected Events, subject to the availability of seats in the hall and after making the appropriate online reservation (Entrance Pass).
- The organizer does not provide the Participant with the opportunity to participate in all Events available within the pass – the number of seats at the screenings is limited and the order of reservations made through the organizer’s website or the GoOut app applies.
- Loss of a wristband or any other case of loss of a pass is equivalent to loss of eligibility to participate in the Festival under them. The vendor does not provide for the issuance of duplicate passes.
§ 7
Right of withdrawal
According to Art. 38(12) of the Law of May 30, 2014. On consumer rights, the right of withdrawal does not apply to the Buyer with respect to a contract whose subject of performance is services related to cultural events, if the contract specifies the day or period of performance of the service; thus, the Buyer is not entitled to withdraw from the contract in the case of online purchase of a ticket for an Event.
§ 8
Return of tickets and passes
- Passes purchased online are non-refundable, except for cancellation of the Festival.
- Tickets purchased online are non-refundable, except for cancellation of the Event.
- Information about Cancelled Events and repertoire changes will be sent to the email address provided in the online order form. In the event that the buyer provides erroneous or false data, the organizer is not responsible for failure to provide the above information to the buyer.
- The seller does not exchange tickets.
§ 9
Complaints
- Any complaints regarding the contract for purchase of passes and/or tickets may be submitted by the Buyer in writing to the Organizer’s address or electronically to agata.myga@octopusfilmfestival.com.
- The complaint must include the name and postal address of the Buyer and the Buyer’s e-mail address.
- Complaints will be processed within 30 days from the date of receipt of the complaint by the Organizer.
- The Organizer will apply the provisions of the Regulations when considering a complaint.
- The Buyer will be notified of the Organizer’s decision in writing to the postal address or electronically to the e-mail address provided in the complaint.
§ 10
Final provisions
- These Regulations are made available by the Organizer through the website www.octopusfilmfestoval.com.
- The organizer reserves the right to make changes to the Festival’s repertoire.
- The organizer reserves the right to conduct and cancel promotional actions.
- The organizer reserves the right to make changes to the Regulations, with all changes being̨ made publicly available on the Festival website.
- Disputes will be resolved by the Organizer.
- The organizer has the right of binding interpretation of the provisions of these regulations
- The Regulations shall come into force on 13.07.2022.
